Further section 2(h) of Equal Remuneration Act,1976 provides for equal remuneration to both men and women and thus prevents any sort of discrimination on grounds of sex. But regrettably, there has been a blatant violation of this article at majority of workplaces.Īrticle 39 (d) of Indian Constitution provides for Equal Pay for Equal Work for both men and women. Although a separate legislation has been enacted to prevent sexual harassment at workplace, but it is not adequate to protect the sufferers of mental harassment which is subject to mockery by superiors as they forget that mental harassment leaves indelible scars on one’s mind. In India, people have a very ludicrous approach towards mental harassment, it is being taken very nonchalantly by superiors at workplace. Infact, major chunk of people have this misconception that harassment at workplace can be sexual only. When these behaviors become repetitive, they are defined as bullying and if the same happens at workplace it amounts to Mental Harassment. They evolve from discriminatory grounds, and have an effect of nullifying or impairing a person from benefiting their rights. It is commonly understood as a behaviour that demeans, humiliates or embarrasses a person, and in legal sense, these are behaviors that appear to be disturbing, upsetting or threatening.
